The Ground Rules (Pun Intended)

 

Welcome to Morning, Bird! Coffee. These terms govern your use of our website and your caffeine procurement from us. By browsing our site or buying our beans, you are agreeing to these terms. If you do not agree, no hard feelings—but please step away from the espresso machine (i.e., don't use our site).

We have tried to keep this readable and devoid of unnecessary "legalese," but some formal language is required to protect us both.

We sell premium coffee designed to transform morning zombies into productive members of society. Our coffee is small-batch roasted by our expert fulfillment partners and shipped directly to your doorstep to ensure peak freshness.

 

2. Who Can Use Our Site

 

To join our flock, you must meet a few criteria:

  • Age requirement: You must be at least 18 years old. (Caffeine is powerful stuff, and so are contracts.)

  • Legal capacity: You must be legally able to enter into binding contracts.

  • Location: We currently only ship within the continental United States.

  • Account accuracy: If you create an account, you promise to provide accurate info. We can't ship coffee to "123 Fake Street."

 

3. Products & Ordering

 

 

What We Sell

 

We sell fresh roasted coffee in various sizes and blends. We describe our roasts and tasting notes as accurately as possible, but taste is subjective—one bird's "nutty" is another bird's "chocolaty."

 

Freshness & Availability

 

  • Roasted to Order: We don't let bags sit on dusty shelves. Your coffee is roasted by our partners (Temecula Coffee Roasters) after you order.

  • Availability: Because we rely on crop harvests and small batches, availability can change. We reserve the right to limit quantities or discontinue products without notice.

 

Pricing

 

  • Currency: All prices are in US dollars.

  • Shipping: Prices include free shipping to the continental US (because paying for shipping kills the vibe).

  • Taxes: Sales tax is added where required by law.

 

4. Payment Terms

 

We accept major credit cards and other secure payment methods displayed at checkout.

  • Timing: Your payment method is charged immediately when you place the order to secure your spot in the roast queue.

  • Issues: If your payment fails, we cannot process the order. You are responsible for any fees your bank charges you for failed transactions.

 

5. Shipping & Delivery

 

 

The Journey to Your Mug

 

  • Processing: Please allow 3-5 business days for roasting. We can't rush perfection.

  • Delivery: Typically takes 3-4 business days after the carrier picks it up.

  • Coverage: Continental United States only.

  • Risk of Loss: Once we hand your package to the carrier (USPS/UPS/FedEx), the responsibility for that package transfers to you. However, if a carrier loses your coffee, let us know—we’ll do our best to help track it down.

 

6. Returns & Refunds

 

 

The "Freshness First" Policy

 

Because coffee is a perishable food product, we cannot accept returns on opened bags just because you decided you prefer a Dark Roast over a Light Roast. However, we stand by our quality.

We WILL refund or replace if:

  1. Damaged: Your package arrived mangled or open.

  2. Stale: The coffee is noticeably stale upon opening.

  3. Error: We sent you the wrong blend.

Process:

Email us at admin@morning-bird-coffee.com within 7 days of delivery. Please include a photo of the damage or error. We process approved refunds within 5-10 business days.

 

7. Acceptable Use

 

You agree to use our site for its intended purpose: buying great coffee.

You may NOT:

  • Use our site for illegal purposes.

  • Attempt to hack, disrupt, or infect our website with viruses.

  • Scrape our content or data.

  • Impersonate us or others.

 

8. Intellectual Property (Who Owns What)

 

All content on this site—including the "Morning, Bird!" name, our logo, product descriptions, and images—belongs to us or our licensors.

  • You Can: Share links to our site or post photos of our coffee on social media (we love that!).

  • You Can't: Copy our branding, resell our images, or claim our content as your own.

 

9. Privacy

 

Your data is safe with us. We don't sell your info. For the full boring-but-important details, see our [suspicious link removed].

 

10. Disclaimers & Limitation of Liability

 

 

The "As Is" Clause

 

Our website and products are provided "as is." While we strive for perfection, we do not warrant that the site will be error-free or uninterrupted.

 

Limitation of Liability

 

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Morning, Bird! Coffee shall not be liable for any indirect, incidental, or consequential damages arising from your use of our site or products. Our total liability to you for any claim is limited to the amount you paid for the specific order related to that claim.

 

Force Majeure

 

We aren't responsible for delays caused by things out of our control, such as natural disasters, severe weather, supply chain collapses, or a global shortage of coffee beans (heaven forbid).

 

11. Dispute Resolution

 

  • Governing Law: These terms are governed by the laws of Florida, United States.

  • Venue: Any legal disputes will be resolved in the courts of Polk County, Florida.

  • Let's Talk First: Before filing a lawsuit, you agree to contact us at admin@morning-bird-coffee.com to try and resolve the issue like civilized adults.

 

12. Changes to These Terms

 

We may update these terms as our business evolves. If we make big changes, we'll post the new version here and update the "Last Updated" date. Continuing to buy coffee from us means you accept the new terms.

  • Shipping: Continental US only. Allow 6-9 business days total (Roasting + Shipping).
